Please read these "Terms & Conditions" carefully before using our website (https://delsanstore.com). By accessing or using this site, you agree to be bound by these terms.

1. Parties

This agreement is concluded between Delsan Store (Delsan Group) (hereinafter referred to as "Delsan" or "Site"), located at "Ostim OSB Mah. 1234. Cad. No: 113 Yenimahalle / Ankara," and the "User" (or "You") who uses the https://delsanstore.com website.

2. Subject of the Agreement

The subject of this agreement is to determine the terms of use of Delsan's website by the User, the conditions for benefiting from the site, and the rights and obligations of the parties regarding purchases made through the site.

3. Description of Services

Delsan conducts the online sale of industrial kitchen equipment, stainless steel products, cooking and cooling devices, and other professional kitchen supplies through its website.

4. User Rights and Obligations

The User agrees to comply with all applicable laws while using the site.

The User undertakes that the information provided when creating an order (address, phone, e-mail) is accurate and up-to-date.

The User shall not engage in activities that threaten site security.

5. Delsan's Rights and Obligations

Delsan reserves the right to make changes to the prices and information of the products offered on the site without prior notice.

Delsan is not responsible for price or stock errors resulting from typographical errors or technical malfunctions. In such cases, Delsan reserves the right to cancel or correct the order.

6. Order, Payment, and Delivery

Order: The User can create an order for products added to their cart on the site. An order is considered confirmed when the payment reaches Delsan's accounts.

• Payment: Payments for orders placed on the site can be made via Credit Card (Online Payment) or Wire Transfer/EFT. For orders placed via Wire Transfer/EFT, Delsan reserves the right to cancel the order if payment is not received within a specified timeframe.
• Delivery: Confirmed orders are delivered to DHL Cargo within 1 (one) to 7 (seven) business days, subject to stock availability. This period does not include force majeure or operational delays.
• Shipping Fee: The shipping fee is automatically calculated by the system based on the total weight and/or volumetric weight (desi) of the order. The calculated shipping cost is clearly shown to the User at the payment stage and added to the order total.
• Damaged Cargo: The User must check the cargo package upon delivery. If there is damage, the User must have the cargo officer issue a "Damage Assessment Report" and must not accept the product. Damage claims without a report may not be processed.

7. Cancellation, Returns, and Warranty Conditions

Order Cancellation: The User has the right to cancel an order as long as its status is "Not Shipped" by notifying Delsan.

Right of Return (Right of Withdrawal): The User has the right to return the product within 14 (fourteen) days from the date of delivery, without stating any reason and without penalty, by exercising their right of withdrawal.

Return Conditions:

To exercise the right of return, the product must not have been installed, must be unused, its original packaging must not be damaged, and the product must be in a resalable condition.

If the User orders the wrong product or if the purchased part is incompatible with the User's equipment, the return can be processed within the 14-day right of withdrawal, provided the above conditions (no installation, etc.) are met.

Return Shipping Fee:

For returns made using the right of withdrawal, the return shipping fee is covered by the User (Customer).

However, if the delivered product is defective (faulty goods), if the wrong product was sent, or if the product does not match the features specified in its description, the return shipping fee will be fully covered by Delsan.

Exceptions to the Right of Withdrawal (Non-Returnable Items):

• a) Products that are custom-manufactured upon the User's request, produced to specific measurements, or modified (e.g., custom-sized stainless steel counters).

• b) Products that have been assembled or installed after delivery.

• c) Products whose packaging has been opened after delivery and are not suitable for return due to hygiene reasons (e.g., cutting tools that come into contact with food).

Warranty Conditions:

• All new products sold on the site are under the warranty of the manufacturer/importer. The legal warranty period is a minimum of 2 (two) years unless otherwise specified.

• The "international standard warranty" conditions or extended warranty periods for the products are specified in the Warranty Certificate and user manual delivered with the product.

• For malfunctions covered under warranty, the User must contact Delsan.

8. Intellectual Property Rights

All logos, designs, texts, images, and codes on the https://delsanstore.com site belong to Delsan. They may not be copied or used without permission.

9. Privacy

Delsan processes Users' personal data in accordance with the Personal Data Protection Law (KVKK). For detailed information, please read the Privacy Policy and KVKK Information Text on our site.

10. Limitation of Liability

Delsan cannot be held responsible for any direct or indirect damages (such as virus infection, data loss, etc.) arising from the use of the site.

11. Force Majeure

The parties are not responsible for failure to fulfill their obligations due to situations beyond their control, such as natural disasters, war, terror, communication interruptions, or epidemics.

12. Amendments

Delsan reserves the right to amend these Terms & Conditions at any time by publishing them on the site.

13. Jurisdiction

Turkish Law shall apply to the resolution of any disputes arising from the implementation of this agreement, and Ankara Courts and Execution Offices shall have jurisdiction.
