ARTICLE 2: SUBJECT OF THE CONTRACT

The subject of this contract is the determination of the rights and obligations of the parties regarding the sale and delivery of the product(s) ("Product/Products"), whose qualifications and selling price are specified below, which the BUYER ordered electronically from the SELLER's website https://delsanstore.com, in accordance with the provisions of the Law No. 6502 on the Protection of the Consumer and the Regulation on Distance Contracts of the Republic of Türkiye.

ARTICLE 4: GENERAL PROVISIONS

4.1. The BUYER declares that they have read the preliminary information regarding the basic specifications, selling price, payment method, and delivery of the product(s) subject to the contract on the website https://delsanstore.com and has given the necessary confirmation in the electronic environment.

4.2. The product(s) subject to the contract shall be delivered to the BUYER or the person/organization at the address indicated, within the period specified on the website (1-7 business days) depending on the distance of the BUYER's place of residence, provided that it does not exceed the legal period of 30 (thirty) days. If this period is exceeded, the BUYER has the right to terminate the contract.

4.3. The SELLER is responsible for delivering the product(s) complete, in accordance with the qualifications specified in the order, and with warranty documents and user manuals, if any.

4.4. Delivery will be made via DHL Cargo. The shipping fee is calculated based on the weight of the products, added to the total order amount, and paid by the BUYER.

4.5. During the delivery of the product, the BUYER is obliged to inspect the product; not to accept damaged or defective goods (dented, broken, torn packaging, etc.) from the cargo company, and to have the cargo officer issue a report. A product that has been received shall be deemed undamaged.

4.6. If the BUYER chooses the Wire Transfer/EFT payment method, the SELLER has the right to cancel the order if the payment is not made within [X business days].

ARTICLE 5: RIGHT OF WITHDRAWAL

5.1. The BUYER has the right to withdraw from the contract within 14 (fourteen) days from the date of receipt of the product, without any legal or penal liability and without stating any reason.

5.2. To exercise the right of withdrawal, a clear notification must be made to the SELLER within this period via the e-mail address [email protected] or phone number +90 312 543 74 74.

5.3. The product to be returned within the scope of the right of withdrawal must be returned to the SELLER complete and undamaged, with its box, packaging, and standard accessories, if any.

5.4. If the right of withdrawal is exercised, the return shipping costs shall be covered by the BUYER. [LEGAL NOTE: For this clause to be valid under Turkish Law, this information must also be clearly stated in the Pre-Information Form.]

5.5. The SELLER is obliged to refund the product price to the BUYER within 14 days at the latest from the receipt of the withdrawal notification, using the payment instrument the BUYER used during the purchase.

ARTICLE 6: CASES WHERE THE RIGHT OF WITHDRAWAL CANNOT BE USED

In accordance with Article 15 of the Turkish Regulation on Distance Contracts, the right of withdrawal cannot be used in the following cases:

• a) Contracts for goods prepared specifically in line with the BUYER's requests or personal needs (e.g., custom-sized stainless steel counters).

• b) Goods whose protective elements such as packaging, tape, seal, or package have been opened after delivery, and whose return is not suitable in terms of health and hygiene.

• c) Contracts for goods that have been assembled or installed after delivery.

• d) Goods or services whose price changes depending on fluctuations in the financial markets and are not under the control of the seller.

ARTICLE 7: WARRANTY AND RETURN CONDITIONS

7.1. The purchased products are under the 2 (two) year manufacturer/importer warranty unless otherwise specified.

7.2. In cases where the BUYER orders the wrong product or the purchased part is incompatible with their existing equipment, the return can be processed within the 14-day withdrawal period (Article 5) and provided it complies with the exceptions in Article 6 (e.g., no installation).

7.3. In case of malfunctions, whether under warranty or not, the BUYER must contact the SELLER (Delsan Store) at [email protected] or +90 312 543 74 74.

ARTICLE 8: RESOLUTION OF DISPUTES AND JURISDICTION

8.1. In disputes arising from the implementation of this contract, the Consumer Arbitration Committees (Tüketici Hakem Heyetleri) in the BUYER's place of residence or where the transaction took place are authorized for applications up to the monetary limit announced annually by the T.R. Ministry of Commerce.

8.2. For disputes exceeding this value, the Consumer Courts (Tüketici Mahkemeleri) are authorized. In places where a Consumer Court is not available, the Courts of First Instance (Asliye Hukuk Mahkemeleri) are competent.

8.3. The parties accept that Ankara (Central) Courts and Execution Offices shall have jurisdiction over disputes arising from this contract.

ARTICLE 9: ENTRY INTO FORCE

The BUYER is deemed to have read and accepted all articles of this contract and the "Pre-Information Form" upon completing the order on https://delsanstore.com. The SELLER is obliged to send a notification of the contract's approval and a copy of the contract to the BUYER's e-mail address.
